Foreign Ownership Restrictions (Reciprocity Based)
OpenSerbia is relatively open to foreign buyers, permitting ownership on a reciprocity basis, but with important limits on land type and protected zones. Confirming reciprocity (or using a company structure) is the key step before investing.
- Foreign individuals can acquire real estate (apartments, buildings, and land beneath buildings) on a RECIPROCITY basis: ownership is permitted if Serbian citizens are allowed to buy property in the foreigner's home country
- Most EU, US, UK, and other Western nationals qualify; reciprocity for a specific country can be confirmed with the Serbian Ministry of Justice
- Where reciprocity does not exist, the foreigner can purchase through a Serbian DOO (limited liability company) that holds the property
- Foreign individuals CANNOT acquire agricultural land; a Serbian company may hold agricultural land subject to separate conditions
- Foreigners cannot acquire property in protected zones such as national parks or designated restricted areas
- All sale contracts must be notarized by a Serbian public notary and ownership registered in the Real Estate Cadastre (RGZ)
